Jorge Martinez of Atlantic Beach, Florida is accused of drugging and raping a 15-year-old girl and then posting a video of her naked on social media. The girl suffered oxygen deprivation due to the drugs and may not survive, sources report.
Martinez, 18, was charged with sexual assault, obscene communication, and delivering a controlled substance to a minor. He was ordered held on $550,000 bond. News sources did not name an attorney for him.
According to Miramar police, Martinez attended a gathering at the alleged 15-year-old victim’s home on June 24. Police say the party ended at around 1 a.m. and Martinez left with the 15-year-old and her friends to go to his home on SW 42nd Street in Miramar. Witnesses reportedly saw him making sexual advances on the teen and giving her Percocet pills.
The girl’s friends later saw a video of her on Marinez’s Instagram account. She was allegedly naked and drugged in the video. Concerned, the girl’s friends went to Martinez’s house to try to locate her.
In the Instagram video, Martinez can reportedly be heard discussing having sex with the victim, saying that “the perc got her knocked out,” in reference to the drugs he allegedly gave her, police said. The video shows the victim laying down naked and unmoving, according to police.
The victim’s friends found her unconscious; her lips were purportedly blue, and she didn’t appear to be breathing. They drove her to a hospital in Hialeah, and she was later flown to Nicklaus Children’s Hospital in Miami in a coma. Her brain was reportedly deprived of oxygen for almost 30 minutes, and she suffered organ failure and internal bleeding. It is unclear if she will survive.
By not calling paramedics, Martinez and the victim’s friends made the situation worse, a Miramar detective said during Martinez’s bond hearing. Instead of taking her to a hospital that was just minutes away, they drove her to a hospital that was almost an hour away.
After the victim was hospitalized, her friends reportedly got into an argument with Martinez that got physical. Martinez was injured, and police were called. He was arrested on Wednesday.
Martinez purportedly told police he only kissed the teen, but he later said he was at the house where she was raped and posted the video on Instagram, the report indicates. After acquiring search warrants to go through Martinez’s phone and home, police reportedly found additional footage that showed the sexual battery of the victim, which had been livestreamed on Instagram.
Unlawful sexual activity with a minor is a second-degree felony. The age of consent in Florida is 18. Minors aged 16 and 17 can give consent to a partner no older than 23, but anyone under 15 can’t legally consent to sex. Sexual activity with 15-year-olds or younger is considered statutory rape.
