Fisher, 45, was charged with sexual assault and battery. Jail records show that he was released on Sunday after posting $20,000 bond. It is unclear if he has acquired the services of an attorney.
According to the Palm Beach County Sheriff’s Office, the alleged sexual assault occurred on June 6 at an apartment complex in the Greenacres area. The 23-year-old victim told investigators that she ordered several pieces of furniture from City Furniture after she moved into the apartment on June 3.
Two deliverymen reportedly came to her apartment on June 6 and to deliver the items she ordered, which included a sofa, a mattress, a loveseat, and a box spring.
The woman said one of the men stepped outside, presumably to take out the packaging material, and the other man remained to take photographs of everything they delivered. The victim told police that he was wearing a red shirt with the name “Richard” on the front.
According to the sheriff’s office, she jokingly told the man that she would quit his job if she were him because it was so hot outside. The man purportedly asked her if she would “take care” of him if he quit his job, and she jokingly pointed to her three-year-old daughter’s bedroom. The man told her no, that was her daughter’s room; he would sleep with her in her room, the report states.
They then stepped into her bedroom so he could photograph the new bed and mattress. The woman reportedly laid down on the mattress with her feet dangling off the side. The deliveryman asked her, “Can we fit on here together?” according to report, and then he got on top of her and started to kiss and fondle her.
The woman tried to pull away and told the man “no” several times, but he reportedly didn’t stop. She was able to make him back off by alluding that they could continue “later,” the police report said. The man allegedly washed his hands and wished her a “blessed day” before leaving.
The victim reported the incident to the police and rape kit evidence was collected. She was later able to pick out Fisher from a photo lineup.
When questioned by police, Fisher denied the allegations, saying that he was married with children and couldn’t have committed the alleged assault.
Police obtained a warrant to collect DNA from Fisher. On August 1, the lab results found that Fisher’s DNA couldn’t be excluded from the sample collected from the victim. A warrant for his arrest was issued on August 28.
Records show that he has no previous arrests in Florida.
City Furniture informed the sheriff’s office that both deliverymen were suspended. The company told the press that it has “stringent policies and vetting procedures in place, including county, state and federal background checks.”
