According to the police report, Botello-Patino allegedly began raping the teen in September 2016. The victim was a virgin at the time. The victim, now 18 years old, told investigators that Botello-Patino raped her again in January at her home and repeatedly raped her for the next nine months.
During one of the alleged incidents, he got so angry after she refused to have sex with him that he threw her on the bed, climbed on top of her and choked her “while laughing,” the report said. The victim told investigators that she agreed to do whatever he wanted sexually out of fear.
Botello-Patino was purportedly so rough with victim during their last encounter that she had to seek medical attention. She learned she was pregnant and had herpes at the hospital.
When questioned by investigators about the alleged sexual encounters, Botello-Patino reportedly confessed to having sex with the victim on multiple occasions, but he said the encounters were consensual.
“The suspect stated he was under the influence of drugs when he would have sex with the victim and blames his actions on his drug use,” the affidavit said.
Another incident involving an adult and a teenage victim was reported in Tamarac earlier this month. Sheldon McDonald, a math teacher at Everest Charter School, was arrested on December 7 after he allegedly had a sexual encounter with a 15-year-old boy.
McDonald, 34, faces charges for promoting sexual performance of a minor. He was ordered held on $5,000 and has since bonded out of jail. He was also ordered not to have any private contact with minors.
According to the arrest report, the alleged sexual encounter took place on October 23. McDonald allegedly offered the teen a ride in his car after seeing him walking down a street in Lauderhill. The teen agreed and entered the vehicle.
McDonald reportedly told the victim that he was new in the area and asked if he could perform a sex act on him in exchange for money. The teen agreed and the older man drove to an empty parking lot where he reportedly performed oral sex on the teen and paid him $20.
After the incident, McDonald drove the teen to his apartment. While he was in the bathroom, the teen left with his vehicle. McDonald reported the car missing and police located it with the teen some hours later. They asked the teen how he came into possession of the stolen vehicle and he told them the whole story, the report said. That led to McDonald’s arrest.
Rape is defined as sex that is forced on another person without their consent or against the person’s will. Sexual battery is a lesser form of this crime and is defined as a sexual encounter that does not necessarily involve sexual intercourse but is still a criminal offense. The younger the alleged victim, the worse the offense and therefore the more severe the penalties.
