The jury in the James Holmes murder trial has reached a verdict. He is on trial for the mass shooting during the showing of Batman at a movie theater in Aurora, Colorado. As you may have read in a previous post about James Holmes, the defense case in chief is predicated on a claim of legal insanity.
According to news reports, the jury’s verdict will be announced from official Verdict Forms at 6:00pm EST. It is important to keep in mind that today’s verdict will only address guilty for the mass murder of 12 people and the injury of another 70 victims. It does not address whether or not Holmes will get the death penalty.
If he is found guilty of first degree murder, which is expected, the case will then be reset for the penalty phase of the trial. During the penalty phase, prosecutors will make their case for the death penalty. While I expect the jury to rule against Holmes’ claim of insanity when it comes to guilt, his mental health problems may ultimately save him from death, if he can convince at least once juror.
